General Terms and Conditions of Entry into Competitions
The following are general terms and conditions which apply to all competitions conducted by the Promoter. Those terms and conditions may be varied or amended by the Promoter from time to time. The Promoter may also publish additional terms and conditions on its competition/promotion page which may apply to particular competitions.
PROMOTER
1. The Promoter is Wendells International Pty Ltd ACN 127 568 138 of 96 Lytton Road, East Brisbane, Queensland ("the Promoter").
WHO MAY ENTER
2. The only persons who may enter and be awarded prizes are residents of the States of Queensland, New South Wales and Victoria who are at least 18 years of age and a current member of wendells.com.au. Employees of the Promoter and their immediate families, related bodies corporate and agencies associated with the promotion are ineligible to enter.
CONDITIONS OF ENTRY
3. By entering the competition, participants agree to be bound by these general terms and conditions and any special terms and conditions appearing on the Promoter's website specific to the particular competition.
LIMITATIONS ON ENTRY
4. Participants may only enter the competition once, unless the special terms and conditions specify otherwise. If more than one entry is received from an entrant, the first received entry will be the only valid one.
DRAW
5. The winner of each prize draw will be selected at random by computer. As there is no minimum or maximum number of entrants for any prize draw, the chances of any particular entrant winning a prize will depend on the total number of entrants for that draw.
NOTIFICATION OF WINNERS
6. Winners of each prize will be notified by email or by post at the discretion of the Promoter.
DECISION FINAL
7. The Promoter's decision in relation to any aspect of the competition is final and binding on every entrant and no correspondence will be entered into.
PRIZES
8. The stated value of a prize is the recommended retail value as provided by the supplier of that prize to the Promoter and is correct at the time of publication on the Promoter's website. All prizes must be taken as offered and are not exchangeable, transferable, redeemable for cash or for resale. In the event that a prize is unavailable, the Promoter reserves the right to substitute a prize of equal or greater value. Prizes unclaimed after a period of one month from the date of notification of the winner may be forfeited and used by the Promoter at the discretion of the Promoter. It is a condition of accepting the prize that the winner may be required to:
(a) provide evidence of identity in a form satisfactory to the Promoter; and
(b) sign a release document in such form as the Promoter may decide in its absolute discretion.
The Promoter accepts no responsibility for any variation in the value of the prize. Where a prize is awarded in the form of a voucher pass or the like ("voucher"), redemption of the voucher is subject to the terms and conditions stipulated on the voucher and any costs in excess of the value of the prize (including GST) and all other ancillary costs associated with redeeming the prize are the responsibility of the winner.
ENTRIES
9. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with the competition is governed by the Privacy Policy mentioned below. Entries not completed in accordance with these general terms and conditions or the published additional terms and conditions of entry or which are received after the closing date will not be considered. No responsibility is taken for late or misdirected email.
CONSENT
10. By entering the competition, the entrant consents to:
(a)receiving email communications regarding the competition, and other emails which inform the entrant of the Promoter's services and events, and to promote third party goods and services; and
(b)the entrant's first name, suburb and city in which they live being published on this website if they win a prize.
PRIVACY
11. The details contained in an entry are protected by security safeguards as detailed in the Promoter's Privacy Policy, which is also available on this website. The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. That personal information will only be used by the Promoter and its related bodies corporate for these purposes.
FAILURE TO RUN
12. If for any reason a competition is not capable of running as planned due to any reason, including but not limited to infection by computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of a competition, the Promoter reserves the right in its sole discretion (subject to any written direction given by a relevant regulatory Authority), to cancel, terminate, modify or suspend the competition.
LIMITATION OF LIABILITY
13. Other than for liabilities and rights of consumers which cannot be excluded by law, the Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using a prize, or with respect to the quality, suitability or merchantability of any goods or services offered as prizes or in relation to the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.
